1. Agreement
By creating an account, downloading, installing, or using the App, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the App. These terms constitute a legally binding agreement between you and the Platform. Your continued use of the App constitutes your ongoing acceptance of these terms as they may be updated from time to time.
It is your responsibility to read and understand these Terms of Service, the Privacy Policy, the Official Challenge Rules, and all relevant instructions, notices, and information provided within the App before and during your use of the Platform. By using the Platform you represent that you have done so.
Acknowledgments. When you create an account, you will be asked to confirm that you are at least 18 years of age and that you have read and agree to these Terms of Service and the Privacy Policy. Each time you enroll in a Challenge, you will be asked to confirm that you have read and agree to the Official Challenge Rules before your enrollment is completed. Each confirmation is recorded with the date and time.
Changes to the App. We may change, suspend, or discontinue any feature of the App at any time, at our discretion. A change does not affect a Challenge you are already enrolled in except as provided in these Terms.
Website purchases. Purchases of merchandise through the Website are subject to the sales terms shown at checkout, in addition to these Terms.
2. Eligibility
To use the Platform you must:
- Be at least 18 years of age
- Be a resident of the United States and physically located in an eligible state at the time of account creation, at the time of each Challenge enrollment, and while taking any steps counted toward a Challenge
- Not be prohibited from participating in skill-based endurance competitions by any applicable law or regulation in your current jurisdiction
- Participate in only one active Challenge at a time
Location verification: The Platform verifies your location at account creation, at each entry into a paid or cash-prize Challenge, and at each withdrawal request, using a third-party provider designed to detect VPN use and location spoofing. If a check places you outside an eligible state, or detects VPN use or location spoofing, the account creation, entry, or withdrawal is blocked. A record of each check is kept as described in the Privacy Policy. It remains your sole responsibility to ensure your participation is lawful in your current jurisdiction at all times. The Platform reserves the right to verify your location at any time, to disqualify entries, and to withhold payouts where participation is determined to violate applicable law.
Age and identity verification: You must confirm that you are 18 years of age or older when you create your account. Before your first withdrawal, you must complete age and identity verification through our third-party verification provider, which compares a government-issued photo ID with a selfie. That process may create biometric identifiers; before it begins you will be asked to consent to their collection on the terms stated in Section 1 of the Privacy Policy, and verification cannot be completed without that consent. Withdrawals will not be processed until verification is complete. Providing false or inaccurate information in connection with verification is grounds for termination of your account and forfeiture of any winnings and wallet balance.
Excluded Persons: The following persons (“Excluded Persons”) may not enter any public Challenge that has an entry fee or awards a cash prize: (a) owners, members, managers, officers, employees, and interns of the Platform, and any other person with an ownership or profit interest in the Platform; (b) any contractor, agent, or other service provider of the Platform, or any of its personnel, who administers Challenges, can affect scoring, prize-setting, or results, or reviews entrants’ non-public scores or step data during a Challenge; (c) any person the Platform compensates to promote the App, while that engagement is in effect, other than a user who earns a Free Entry under the referral program described in Section 11; and (d) members of the household of any person described in (a) through (c). A “non-public Challenge” is a Challenge that only users invited by the Platform can join; every other Challenge is a “public Challenge.” Excluded Persons may enter Challenges that award no cash prize, and may enter a non-public Challenge that has an entry fee or awards a cash prize only if every entrant in it is an Excluded Person; no other user may join such a Challenge. No administrator account of the Platform appears on the leaderboard of any public Challenge. If an Excluded Person is found to have entered a public Challenge that has an entry fee or awards a cash prize, the Platform may remove the entry at any time and withhold any associated prize, and any prize position that entry would have occupied passes to the next eligible entrant.
Step history requirement: To enroll in a Challenge, your account must have a history of recorded step data over the preceding 4 weeks. This requirement helps ensure that your step source is active and reliably recording before you compete. Manually entered step data does not count toward this requirement. If your account does not meet the step history requirement, you will not be able to enroll until sufficient recorded step data is present. The Platform may adjust the parameters of this requirement at any time and at its sole discretion.
Rank requirement: The Platform assigns each account a rank tier based on your recent step activity, recalculated regularly. You may enroll only in Challenges at or above your assigned rank. A change in your rank during a Challenge does not affect that Challenge. Where activity associated with your account is flagged as irregular, the Platform may hold your rank tier at its current level (a “rank lock”) while the activity is reviewed under Section 16.
Self-exclusion: You may exclude yourself from paid and cash-prize Challenges at any time from the App’s Settings, for a period of 30 days, 90 days, one year, or permanently. A self-exclusion cannot be shortened or reversed before the period you selected has ended. While a self-exclusion is in effect you may access your account, view your statistics, and withdraw any wallet balance, but you may not enter any Challenge that has an entry fee or awards a cash prize.
Eligible states: The Platform is available only to users physically located in the states listed in the App and in the Official Challenge Rules at the time of account creation, at the time of each Challenge enrollment, and at the time of each withdrawal. It is your sole responsibility to ensure that your participation is lawful in your current jurisdiction at all times. The Platform reserves the right to disqualify entries and withhold payouts where participation is determined to be in violation of applicable law.
You may maintain only one account per person. If the Platform discovers that you have opened more than one account, we reserve the right to suspend or terminate any or all of your accounts and forfeit any associated winnings or wallet balance.
3. Account Security and Communications
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information when you create your account and to keep that information updated. We send a verification link to the email address on your account. You must verify that address before you can request a withdrawal, and if you change your email address you must verify the new one. You must notify us immediately at hello@moneystep.app if you believe your account has been accessed or used without your authorization. The Platform is not liable for any loss arising from unauthorized use of your account. You may not share your account with, or use the account of, any other person.
Communications. We send transactional messages about your account and the Challenges you enter, including enrollment, cancellation, settlement, withdrawal, and verification notices, by push notification or email. You can manage push notifications in Settings, but you cannot opt out of messages required to operate your account, a Challenge you are enrolled in, or a review under Section 16, or of legal notices such as changes to these Terms. You agree that notices we send to the email address or device associated with your account satisfy any requirement that a notice be in writing.
4. Skill-Based Competition
The Platform operates skill-based endurance competitions. Each Challenge is decided by the entrant’s own total step count over the Challenge period. Challenge outcomes are determined entirely by step count performance, which reflects physical effort, fitness level, and activity — and not by chance, luck, or any random element.
The Platform is not a game of chance and is not gambling. Winning depends solely on the number of steps a participant physically takes, which is an action wholly within each participant’s own control and influence. The Platform does not reward participants for any outcome determined by chance. No prize, placement, or tiebreak is allocated by chance. Any attempt to win based on anything other than steps you physically take — including any manipulation of step or health data — is strictly prohibited and is grounds for disqualification and forfeiture.
By participating, you acknowledge that results are based on skill and physical effort, that no outcome is guaranteed, and that the Platform makes no representations regarding your likelihood of winning any Challenge.
5. Entry Fees and Payment
How payment works: Entry fees paid by card or another external payment method are collected through a licensed third-party payment processor. When you enroll in a paid Challenge, the processor places an authorization on your payment method, and funds are captured when the Challenge starts. If the Challenge does not proceed, any authorization is released and any entry fee already captured is refunded in full. If the processor cannot capture your entry fee when the Challenge starts — for example, because your payment method is declined or the authorization has expired — you are not entered in the Challenge, your enrollment is cancelled, and you are not charged. If the processor is temporarily unavailable when the Challenge starts, collection is retried. The posted start and end times do not change, and an entry whose fee has not been collected within 3 hours after the scheduled start is removed and its authorization released. An entrant whose fee cannot be captured is not counted toward the Challenge’s minimum number of entrants. An entry fee paid from your wallet balance is deducted from your wallet when you enroll and restored to your wallet if the Challenge does not proceed.
Entry fees: Each paid Challenge has a flat entry fee, stated in full on the Challenge card before you enter and fixed once posted. The entry fee is the price of entry to the Challenge. It is not a contribution to a shared fund, and no part of it is described or calculated as a percentage of any prize. Entry fees do not exceed $40 per Challenge.
Card processing fee: If you pay an entry fee by card or another external payment method, a card processing fee is added that passes through what our payment processor charges for the transaction, with no markup. The entry fee, the card processing fee, and the total are each shown to you before you confirm payment, and the total is the amount authorized on your payment method and captured when the Challenge starts. The card processing fee is separate from the entry fee, funds no prize, and is not calculated by reference to any prize. No card processing fee applies to an entry fee paid from your wallet balance or to a Free Entry. The card processing fee is not part of the entry fee and does not count toward the $40 entry-fee limit. Wherever these Terms provide that an authorization is released or an entry fee is refunded, the card processing fee is released or refunded with it; wherever an entry fee is non-refundable, the card processing fee is non-refundable too.
Free Challenges: Some Challenges have no entry fee and still award cash prizes. Free Challenges are governed by these Terms in the same way as paid Challenges, except that the entry-fee, payment, and refund provisions do not apply. No prize in a free Challenge is allocated by chance.
Bank fees and chargebacks: If a charge results in an overdraft or other fee from your bank, that fee is your responsibility. If you dispute or reverse a captured entry fee with your card issuer or bank, the Platform may remove you from the Challenge, withhold any prize for it, and hold your wallet balance until the dispute is resolved. If the dispute is resolved against you, we may deduct the disputed amount and any associated fees from your wallet balance.
6. Prizes and the Prize Guarantee
Prizes: For each paid Challenge, the paid places and the amount awarded for each place are set by the Platform or by a sponsor and posted on the Challenge card before enrollment opens. Prize amounts do not vary with the number of entrants or with the amount of entry fees collected. Prizes are funded from a segregated prize reserve, which may be a single account used across Challenges with each Challenge’s prizes recorded separately, funded before enrollment opens in the amount of the posted prizes. Once a Challenge proceeds, the posted prizes are paid in full whether or not entry fees cover them. The only conditions on payment of a posted prize are that the Challenge proceeds and that an eligible entrant finishes in that place.
The prize guarantee and its single condition: Every Challenge states a minimum number of entrants before enrollment opens. That minimum is the only condition on the Challenge proceeding. The minimum is measured when the Challenge starts, once entry fees are captured — including any collection retried under the delayed-collection provision — and no later than 3 hours after the scheduled start; an entrant whose entry fee cannot be captured is not counted. If fewer than the minimum number of entrants remain enrolled at that point, the Challenge does not proceed: it is cancelled automatically, any entry fee already captured is refunded in full, remaining authorizations are released, no result is recorded, and no prize is awarded. If enrollment closes with fewer than the minimum number of entrants, the Challenge is cancelled at that point and no entry fee is captured.
If the minimum is met, the Challenge proceeds and the posted prizes become an obligation of the Platform, conditional only on an eligible entrant finishing in each paid place. They are paid in full, exactly as posted, regardless of how many entrants above the minimum enroll, regardless of how much is collected in entry fees, and regardless of whether entry fees cover the prizes. The Platform bears any shortfall. No prize amount is reduced, withheld, or recalculated because enrollment was lower than expected. If fewer eligible entrants finish than there are paid places, the unfilled places are not paid.
Ties: If two or more entrants tie for a cash-winning placement, they split the combined payouts of the placements occupied by the tied entrants. For example, if three entrants tie for 4th place in a Challenge with ten cash-winning places, those three split the combined 4th, 5th, and 6th place payouts, and the entrant with the next-highest step count receives the 7th place payout. If entrants tie for the final cash-winning place, they split that single payout. Because ties can affect the amount an individual entrant receives, posted per-place amounts are shown as expected amounts until the Challenge is settled.
7. Cancellation and Refunds
Cancellation before a Challenge starts: The Platform may cancel a Challenge at any time before it starts, for failure to meet the minimum entrant count or for any other reason. On cancellation, every authorization is released, any entry fee already captured is refunded in full, and any wallet-paid fee is restored to the wallet. A Free Entry applied to a cancelled Challenge is restored.
Cancellation after a Challenge starts: The Platform may cancel a Challenge after it has begun only where the Challenge cannot be completed fairly or lawfully, including a technical failure affecting the integrity of scoring, a legal or regulatory requirement, or an event described in Section 29. In that case no results are recorded for that Challenge, no prizes are awarded, no result is entered in the career statistics of any entrant still enrolled, and the entry fee of every entrant still enrolled when the Challenge is cancelled is refunded in full, with fees paid from a wallet balance restored to the wallet. An entrant who exited before the cancellation is not refunded, and that exit remains in their career statistics. A Free Entry applied to that Challenge by an entrant still enrolled is restored.
No other refunds: Except as described above, all entry fees are final and non-refundable once a Challenge has started. An entry fee will not be returned for voluntary exit, injury, illness, device malfunction, loss of connectivity, step sync failure, removal for prohibited conduct, or dissatisfaction with results.
Refund timing: Refunds of entry fees are returned to the original payment method and may take several business days to appear, depending on your bank.
8. Exiting a Challenge
You may voluntarily exit a Challenge at any time before or after it begins. For the period while entry fees are being captured — up to 3 hours after the scheduled start if the payment processor is temporarily unavailable — exits are unavailable; you may exit again once the Challenge has started. The following rules apply:
Before the Challenge starts: You will be removed from the Challenge, your entry-fee authorization is released (or, if you paid from your wallet, the fee is restored to your wallet, or, if you used a Free Entry, it is restored), and you are not charged. You are free to join another Challenge immediately.
After the Challenge starts: Your entry fee is non-refundable, and a Free Entry applied to that Challenge is not restored. You will be removed from the Challenge and leaderboard. You are free to join another Challenge immediately after exiting.
Exits are recorded in your career statistics. Exiting mid-Challenge counts as a last-place finish for statistical purposes. Steps you took during an exited Challenge are not credited toward your career step totals or any global leaderboard.
9. Wallet, Payouts, and Withdrawals
Payouts: Prizes are credited to your in-app wallet when the Challenge is settled. All amounts on the Platform are in U.S. dollars. When you request a withdrawal, we submit it to our licensed third-party payment processor within ten (10) business days after your request clears the location and verification checks described in Section 2; the time for funds to reach you after that depends on the processor and your bank. If activity associated with your account is under review under Section 16, the withdrawal is held until the review is complete and may take longer.
Your in-app wallet: Your wallet holds only prize winnings, including winnings returned to it when an entry fee paid from your wallet is restored. You may not deposit funds into your wallet, and the Platform does not issue credits, bonuses, or promotional balances to it. Wallet funds may not be transferred to another user. You may request a withdrawal of your balance at any time, or apply it toward the entry fee for a future Challenge. Every withdrawal is subject to verification of your email address under Section 3, the location and identity checks in Section 2, the tax-information requirements in Section 10, any hold under Section 16, and the processing time stated above. An entry fee paid from your wallet balance is subject to the same terms as any other entry fee. Your wallet is not a bank or deposit account, balances are not insured by the FDIC or any government agency, and no interest is paid on them.
Inactive balances: If your account has no sign-in, Challenge entry, or withdrawal for twelve (12) consecutive months, we will notify you at least thirty (30) days in advance and then pay your wallet balance to you automatically using the payout method on file. If we cannot pay it — for example, because you have not completed identity verification or provided a valid payout method — we will continue to hold it for you and, where required, report and remit it as unclaimed property under applicable state law. If we close the Platform, or end your account for any reason other than a violation of these Terms, we will pay out any remaining balance in the same way.
Accurate payout information is your responsibility: You are solely responsible for providing accurate and complete payment information when requesting a withdrawal. If you provide incorrect, incomplete, or invalid payment information, your payout may be sent to the wrong recipient or fail to process, and the Platform is not responsible for funds lost as a result. We will not issue a replacement payout, refund, or reimbursement of any kind for payouts misdirected or lost due to information you provided. It is your responsibility to verify your payment details are correct before submitting a withdrawal request.
10. Tax Obligations and 1099 Reporting
You are solely responsible for all taxes arising from prizes and winnings earned through the Platform. In accordance with United States tax law:
- If your cumulative gross winnings in a single calendar year equal or exceed $2,000, the Platform is required to issue you a Form 1099 and report your earnings to the IRS
- Upon crossing that threshold, you will be required to provide a valid Social Security Number (SSN) or Employer Identification Number (EIN) before further payouts may be processed
- Failure to provide required tax information may result in a hold on your winnings until the information is received
- You agree to provide accurate and complete tax information upon request and to notify us of any changes
The Platform is not responsible for any tax liability you incur as a result of winnings. We recommend consulting a qualified tax professional regarding your individual obligations.
11. Points and Referral Program
Points: Entrants who finish a Challenge outside the cash-winning placements receive points. Points are not a prize and have no cash value. They cannot be converted to cash, withdrawn, transferred to another user, or used to pay an entry fee, and they have no value outside the App. Points may be redeemed only for a discount on Moneystep merchandise. We may modify, suspend, or end the points program at any time; points already earned remain redeemable for a reasonable period after any such change.
Referral Program and Free Entries: Each account is issued a unique referral code. A referral is successful when a new user enters your code at sign-up and subsequently completes their first paid Challenge — meaning a Challenge with an entry fee that the user paid themselves and that runs to settlement. Entries funded by wallet balance or by a Free Entry do not qualify as a paid Challenge for this purpose. When a referral is successful, referral credit is granted to both the referring user and the referred user.
Upon an account accruing five (5) referral credits, the account is granted one Free Entry: entry into a single paid Challenge of the user’s choosing with the entry fee covered by the Platform. A Free Entry is granted at most once per account, regardless of further referral credits. A user who joins a Challenge using a Free Entry competes on the same terms as paying entrants, including prize eligibility; the Challenge remains a paid Challenge, and only that user’s entry fee is covered. A Free Entry applied to a Challenge is restored if the user exits before the Challenge starts, and is not restored if the user exits after it starts.
A Free Entry has no cash value, cannot be transferred, sold, or exchanged, and cannot be applied retroactively or combined with any other payment method. Referral credit and Free Entries may be revoked, and accounts may be suspended or terminated as described in Sections 16 and 17, where we determine referrals were obtained through fraud or abuse, including self-referrals, referrals of duplicate or fabricated accounts, or any coordinated scheme to generate referrals. We may modify, suspend, or end the referral program at any time; changes do not affect a Free Entry already granted.
12. Step Data Sync Requirements
To ensure accurate leaderboard standings and final results, users are responsible for the following:
- A connected step source is required. The App reads your step data from Apple Health (iOS) or Google Health Connect (Android). You are responsible for ensuring a step source is actively recording steps into your health app and that the App has been granted permission to read it. On Android in particular, Health Connect does not record steps on its own — it only stores step data provided by another app or a connected wearable. If no step source is feeding your health app, or if permission is not granted, your steps will register as zero regardless of your physical activity. It is your sole responsibility to confirm your steps are being recorded before and during a Challenge.
- Background sync permission is required to enroll. To enroll in a Challenge, you must grant the App permission to read your step data while the App is in the background or closed, when prompted during enrollment (on iOS, through the Apple Health permissions screen; on Android, through the Health Connect background-access permission). This allows the App to keep your counted step total reasonably current on the Challenge leaderboard without requiring you to open the App. Where your device reports the status of this permission, the App may decline enrollment while it is not granted. You agree to keep this permission enabled for the duration of any Challenge you enter and its post-Challenge sync window. Background syncing is best-efforts and controlled by your device’s operating system; it supplements, and does not replace, your responsibilities under this Section. Sync recency is visible to other entrants. The time your steps were last synced to the Platform is displayed with your entry on the live leaderboard of any Challenge you are enrolled in.
- A single step source is used, and only that source counts. Before enrolling, one step source is set for your account — Apple Health by default on iOS, and Garmin on Android, which requires a connected Garmin device — and you may change it in Settings at any time before you enroll. Only steps recorded by that source will be counted toward your Challenge results; steps from any other app, device, or source will not be included. The source is locked to your entry at the time you enroll and cannot be changed for the duration of that Challenge. It is your responsibility to choose the source that accurately reflects the steps you physically take and to keep that source recording throughout the Challenge. If your selected source stops recording or syncing, your step total may stop advancing, and the most recently synced total will be used. Manually entered steps are never counted, regardless of source. On iOS, eligible sources are Apple Health (covering your iPhone’s built-in step counter and Apple Watch), Oura, and Garmin. On Android, Garmin is currently the only eligible source — if you use an Android device without a connected Garmin, no eligible step source is available to you and you will not be able to accumulate countable steps. Eligible sources may change as devices and platforms change.
- Keep your apps synced during a Challenge. During an active Challenge, make sure your steps and any connected health or fitness apps (such as your wearable’s companion app, for example Oura or Garmin Connect) are synced and up to date, and open the App regularly during the Challenge. The App reads your step data from Apple Health or Google Health Connect when you open the App, and those services only contain your latest steps if your phone and any connected apps have synced.
- Post-Challenge sync window. After a Challenge has ended, make sure your steps and any connected health or fitness apps are synced and up to date, and open the App within 24 hours of the Challenge end time, so your complete step data is captured before results are finalized.
- Settlement timing. Challenge results are finalized approximately 24 hours after the Challenge end time. Step data not synced by settlement will not be included in your final result.
- Incomplete sync liability. If you fail to sync within the 24-hour post-Challenge window, your recorded step count at the time of settlement will be used as your final total. The Platform is not responsible for any difference between your actual steps and your synced step count.
- Syncing depends on your apps and on opening our App. The App syncs your steps when you open it, and it can only read steps that your phone and connected apps have already synced into Apple Health or Google Health Connect. When you have granted background access, the App attempts to sync your steps periodically while it is closed or in the background, but background syncing is controlled by your device’s operating system, is not guaranteed to run at any particular time or frequency, and may be prevented by device settings, battery optimization, or platform restrictions. You should not rely on background syncing alone. Keeping your health and fitness apps synced, and opening the App to sync — including within the post-Challenge window described above — remains your responsibility.
- Android users: refresh Garmin Connect at the end of each day. On Android, Moneystep reads your steps from Google Health Connect, and Health Connect holds only what the Garmin Connect app has written into it. Steps that remain on your watch and have not synced to Garmin Connect do not exist as far as the App is concerned. Refresh Garmin Connect at the end of each day, after you have taken your steps for that day. Refreshing earlier in the day does not reliably write that day’s full step count into Health Connect, and steps taken after an early refresh may not be written for that day at all. This is a limitation of how Garmin Connect and Health Connect exchange data and is outside the Platform’s control. We also recommend opening Moneystep once a day so you can confirm your total is advancing as expected. If your recorded total is lower than the steps you physically took because your source did not sync, the Platform is not responsible for the difference.
- Android battery optimization. Some Android device manufacturers (including but not limited to Samsung, Xiaomi, Huawei, and OnePlus) apply aggressive battery-saving features that can prevent the App from receiving notifications and can interfere with syncing between Garmin Connect, Health Connect, and the App. If you use one of these devices, we recommend exempting both Moneystep and Garmin Connect from battery optimization in your device settings. You can typically find this under Battery → App optimization or Battery → Background usage limits. The Platform is not responsible for missed notifications or incomplete step data resulting from manufacturer battery-optimization settings.
- No liability for device or connectivity issues. The Platform is not responsible for incomplete, missing, or delayed step data resulting from device settings, device failures, manufacturer restrictions, network outages, or failure to sync within required timeframes.
- If you never open the App, your steps cannot be recorded. If you do not open the App at all during a Challenge and also do not open it within 24 hours after the Challenge ends, no step data can be captured for that Challenge. In that case your steps cannot be recorded and your final total for the Challenge will be zero (0), regardless of how many steps you physically took.
- Disputing your final result. It is your responsibility to raise any dispute about your own result in a settled Challenge in time. If you believe your final step count or placement is incorrect — for example, steps you physically took were not counted — you must notify us at hello@moneystep.app within seven (7) days after that Challenge is settled. Your notice must identify the Challenge and describe the claimed error. After that seven-day window, your final result is deemed accepted and final as to you and is no longer subject to dispute or adjustment on your request. Whether and how to act on any notice is within the Platform’s sole discretion, and nothing in this section obligates the Platform to change any result or to act within any particular timeframe.
13. Health, Safety, and Assumption of Risk
Important: Physical exercise carries inherent risk of injury, illness, and death, particularly for individuals with pre-existing health conditions, prior injuries, or those who are not regularly physically active.
By participating in Challenges on the Platform, you acknowledge and agree that:
- You are voluntarily choosing to engage in physical activity and do so entirely at your own risk
- You have consulted or will consult with a qualified healthcare provider before beginning any new or increased exercise program
- The Platform is not responsible for any injury, illness, death, disability, or adverse health outcome of any kind arising from or related to your participation, including but not limited to overexertion, cardiovascular events, musculoskeletal injuries, or accidents occurring while walking, running, or otherwise engaging in physical activity in connection with the Platform
- You hereby release, waive, discharge, and covenant not to sue the Platform and its operators, officers, employees, agents, successors, and assigns from any and all claims, demands, damages, causes of action, or liabilities of any kind arising from physical activity undertaken in connection with the Platform, whether caused by negligence or otherwise, to the fullest extent permitted by applicable law. In jurisdictions that do not permit the release of negligence claims, this release applies to the maximum extent permitted.
The App is a fitness and step-count competition app. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Consult a qualified healthcare provider for any medical concerns.
14. User Content and Publicity
The Platform allows you to provide a username and a profile photo (together, “User Content”) that other users can see. You are solely responsible for your User Content. You represent and warrant that you own or have all necessary rights to any User Content you provide and that it does not infringe or violate the rights of any third party. You may not use a username or profile photo that is unlawful, infringing, obscene, sexually explicit, harassing, hateful, that impersonates another person, or that the Platform otherwise deems objectionable. By providing User Content, you grant the Platform a non-exclusive, worldwide, royalty-free license to store, display, and use that content for the purpose of operating the Platform. The Platform reserves the right, but is not obligated, to review, refuse, or remove any User Content at any time, for any reason, in its sole discretion.
Winner announcements. If you win a prize, we may publish your username and your placement in announcements of Challenge results, including on our social channels. We will not publish any other information about you in those announcements unless you agree.
Feedback. Any suggestions, ideas, or feedback you send us about the App may be used by the Platform without restriction or compensation to you.
15. Prohibited Conduct
You agree not to engage in any of the following, including but not limited to:
- Manually entering, editing, importing, or otherwise inputting step or health data by hand into Apple Health, Google Health Connect, or any other source rather than physically taking the steps. Only steps automatically recorded by an eligible step source as described in Section 12 count toward Challenges; manually entered steps are excluded and any attempt to submit them is considered an attempt to manipulate Challenge results
- Using any device, software, application, or method to artificially inflate your step count, or any other manipulation of step or health data
- Creating multiple accounts or participating under a false identity
- Using another person’s account or allowing another person to use yours
- Entering a paid or cash-prize Challenge that Section 2 does not permit you to enter
- Submitting payment using a payment method you do not own or are not authorized to use
- Attempting to exploit bugs, vulnerabilities, glitches, or technical malfunctions in the App
- Using bots, scripts, macros, or other automated means to interact with the App, submit data on your behalf, or otherwise circumvent these Terms. This does not apply to the health and wearable apps described in Section 12, which the App relies on to read your step data
- Using a VPN, proxy, location-spoofing tool, or any other method to disguise or misrepresent your location
- Decompiling, disassembling, reverse engineering, modifying, repackaging, or attempting to extract or reuse the source code or any component of the App, or creating any derivative or modified version of it
- Engaging in collusion, coordination, or any agreement with other participants to manipulate Challenge outcomes or share winnings
- Using the App while physically located in a jurisdiction that is not an eligible state, regardless of where your account was created
- Engaging in any conduct that disrupts, damages, or impairs the App or other users’ experience
- Impersonating any person or entity, or misrepresenting your identity or affiliation
Violation of any of these prohibitions may result in account termination, forfeiture of any wallet balance and pending winnings, removal from active Challenges without refund, and potential civil or criminal legal action. Any user found to have cheated, falsified or manipulated step data, or otherwise violated these Terms may be permanently banned from the Platform; permanent bans are final, and a banned user is not entitled to reinstatement and may not create a new account.
16. Integrity Reviews, Holds, and Appeals
Verification requests. The Platform may request additional verification of your identity, activity, or step data at any time, including where we identify suspicious, irregular, or anomalous activity. If we request verification, you must respond within seven (7) days. We will send at least two notices during that period.
Funds are held, not forfeited, while a review is pending. While a verification or investigation is pending, we may place a hold on winnings, wallet balance, and any pending or requested withdrawal associated with the activity under review, and decline to process it until the review is complete. We may also apply a rank lock as described in Section 2. Funds in your account that are not associated with the activity under review are not held. We are not obligated to release held funds while a review is ongoing.
Written determination and forfeiture. At the conclusion of a review we will provide you with a written determination stating the basis for our decision. Forfeiture of held funds occurs only where we determine that a violation occurred. If you do not respond within the seven-day period, or if you provide false or incomplete information, we may make a determination on the information available to us, and may disqualify you from the Challenge, suspend or terminate your account, and forfeit the associated funds.
Appeal. You may appeal a determination by writing to hello@moneystep.app within seven (7) days of the determination. An appeal is reviewed by a person other than the person who made the original determination, and we will respond within ten (10) business days. The decision on appeal is final. You must complete this appeal process before commencing arbitration under Section 22 in respect of that determination.
Repeated suspicious activity. The Platform monitors Challenge activity for signs of manipulation, irregularity, or other conduct inconsistent with these Terms. Where your activity is repeatedly identified as suspicious, the Platform may suspend or permanently terminate your account, whether or not any individual instance was separately confirmed as a violation and whether or not you were notified of any prior instance. Any wallet balance and pending winnings are forfeited only where the Platform determines that a violation occurred, subject to the appeal process; otherwise they are paid out to you. The methods, criteria, and thresholds the Platform uses to identify suspicious activity are confidential and are not disclosed.
Reporting suspected cheating. If you believe another participant has cheated or otherwise manipulated a Challenge, you may report it to us at hello@moneystep.app at any time. The Platform is under no obligation to investigate, reverse, or adjust any result or payout in response to a report, and any action it takes is within its sole and absolute discretion. Amounts already paid out or withdrawn may be impractical to recover, and the Platform does not guarantee recovery or reimbursement. This does not limit the Platform’s independent right to investigate and act on suspected cheating on its own initiative at any time.
17. Account Termination
The Platform reserves the right to suspend, restrict, or permanently terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these terms, suspicious or fraudulent activity, chargebacks, failure to provide required tax information, failure to complete age or identity verification, or any other reason necessary in our sole judgment to protect the Platform and its users. Upon termination for a violation of these Terms, any pending winnings, wallet balance, or other amounts owed to you may be forfeited in full, subject to the determination and appeal process in Section 16. The Platform shall not be liable to you or any third party for any termination of your account.
18. Intellectual Property
The App, and all content and materials made available through it — including the Moneystep name, logo, design, text, graphics, and software (excluding content you provide) — are owned by the Platform and its licensors and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Platform for your own personal, non-commercial use, subject to these Terms. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from any part of the App, and you may not use the Platform’s name, logo, or trademarks without our prior written permission. All rights not expressly granted to you are reserved by the Platform.
19. Disputes Between Users
You are solely responsible for your interactions with other users, including through friend connections, leaderboards, and any other social feature of the Platform. The Platform is not a party to, and has no responsibility for, disputes between users. We reserve the right, but have no obligation, to monitor or intervene in any dispute between users, and any decision we make in doing so is final. You release the Platform from any claims, demands, or damages arising out of or related to any dispute with another user.
20. Indemnification
You agree to indemnify, defend, and hold harmless the Platform and its operators, owners, officers, employees, agents, successors, and assigns from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the App; (b) your participation in any Challenge; (c) any content you submit, post, or display, including your username and profile photo; (d) your violation of these Terms or the Privacy Policy; (e) your violation of any applicable law or regulation; or (f) your violation of the rights of any third party. The Platform reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with the Platform’s defense of that claim.
21. Disclaimers and Limitation of Liability
The App and all related services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components. Use of the App is entirely at your own risk.
To the maximum extent permitted by applicable law, the Platform and its operators, officers, employees, agents, successors, and assigns shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages of any kind, including but not limited to loss of profits, loss of data, loss of goodwill, loss of winnings, personal injury, property damage, or any other intangible losses, arising from or related to your use of or inability to use the App, regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if the Platform has been advised of the possibility of such damages.
Our total aggregate liability to you for any and all claims arising from or related to these terms or your use of the App shall not exceed the total entry fees paid by you in the 90 days immediately preceding the claim giving rise to liability. This limitation does not apply to the Platform’s obligation to pay a prize you have won or to return a wallet balance you hold, each as provided in Sections 6 and 9. It otherwise applies to the fullest extent permitted by law.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such jurisdictions, the above limitations apply to the fullest extent permitted by applicable law.
22. Dispute Resolution and Waiver of Class Action
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Before commencing arbitration of any dispute concerning an integrity determination, you must first complete the internal appeal process described in Section 16.
Any dispute, claim, or controversy of any kind arising out of or relating to these Terms, the Privacy Policy, the Platform, or your use of any services provided through the Platform — including but not limited to disputes regarding formation, validity, enforceability, performance, breach, termination, or any other matter — shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in the State of Texas.
Waiver of class action and representative claims: YOU AND THE PLATFORM EACH IRREVOCABLY WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN ANY CLASS ACTION LAWSUIT, CLASS-WIDE ARBITRATION, PRIVATE ATTORNEY GENERAL ACTION, CONSOLIDATED ARBITRATION, OR ANY OTHER REPRESENTATIVE OR COLLECTIVE PROCEEDING OF ANY KIND AGAINST THE OTHER. All disputes must be brought in your individual capacity only. If a court or arbitrator finds that this class action waiver is unenforceable with respect to any claim, then the arbitration agreement shall not apply to that claim, and that claim shall proceed in court — but the waiver shall remain in full force for all other claims.
By agreeing to these Terms, you expressly waive your right to a jury trial and your right to participate in any class or representative action. This waiver is a material and non-severable condition of your use of the App or the Platform. If you do not agree to this waiver, you may not use the App or the Platform.
23. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in the State of Texas, and you irrevocably consent to personal jurisdiction and venue in such courts.

25. App Store and Platform Terms
The stores are not sponsors: All Challenges, competitions, and prizes offered through the Platform are provided by the Platform or by a third-party sponsor identified in connection with a particular Challenge. Apple Inc. and Google LLC are not sponsors of, and are not involved in, the Challenges or the Platform in any manner. Any questions, complaints, or claims regarding the Platform or a Challenge should be directed to us at hello@moneystep.app, not to Apple or Google.
This Agreement is between you and the Platform only, and not with Apple or Google. The Platform, and not Apple or Google, is solely responsible for the App and its content.
If you obtained the App from the Apple App Store, the following additional terms apply: (a) Apple has no obligation to furnish any maintenance or support for the App; (b) to the maximum extent permitted by applicable law, Apple has no warranty obligation with respect to the App, and in the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the App to you, if any, and to the maximum extent permitted by law Apple will have no other warranty obligation whatsoever with respect to the App; (c) the Platform, not Apple, is responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer protection or similar legislation; (d) the Platform, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party claim that the App or your use of it infringes that third party’s intellectual property rights; (e) you represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties; and (f) Apple and its subsidiaries are third-party beneficiaries of this Agreement and, upon your acceptance of these Terms, will have the right to enforce this Agreement against you as a third-party beneficiary.
If you obtained the App from the Google Play Store, you acknowledge that this Agreement is between you and the Platform only, and not with Google, that Google is not responsible for the App or its content, and that Google is not a sponsor of or involved in any Challenge.
26. Survival
The following provisions survive any termination or expiration of these Terms or of your account, and any deletion of your account: Entry Fees and Payment (Section 5); Prizes and the Prize Guarantee (Section 6); Cancellation and Refunds (Section 7); Wallet, Payouts, and Withdrawals (Section 9); Tax Obligations (Section 10); Data Retention & Deletion (Privacy Policy, Section 6); Health, Safety, and Assumption of Risk (Section 13); Prohibited Conduct (Section 15); Integrity Reviews, Holds, and Appeals (Section 16); Intellectual Property (Section 18); Disputes Between Users (Section 19); Indemnification (Section 20); Disclaimers and Limitation of Liability (Section 21); Dispute Resolution and Waiver of Class Action (Section 22); Governing Law (Section 23); and the App Store and Platform Terms (Section 25) — together with any other provision that by its nature should survive.
27. Assignment
You may not assign or transfer these Terms, or any of your rights or obligations under them, to anyone else, and any attempt to do so is void. The Platform may assign or transfer these Terms, in whole or in part, at any time without restriction, including in connection with a merger, acquisition, reorganization, or sale of all or substantially all of its assets. These Terms bind and benefit each party’s permitted successors and assigns.
28. No Waiver
The Platform’s failure to enforce any provision of these Terms, or to act on any breach, does not waive our right to enforce that provision or to act on that or any later breach. No waiver of any provision of these Terms is effective unless made in writing, and a waiver in one instance does not waive any other provision or any future instance.
29. Force Majeure
The Platform is not liable for any delay or failure to perform resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, fire, flood, severe weather, war, terrorism, civil unrest, labor disputes, government action, public health emergencies, power or internet outages, or the failure or interruption of third-party services, networks, devices, or infrastructure.
30. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the validity and enforceability of the remaining provisions.
31. Entire Agreement
These Terms of Service, the Privacy Policy, and the Official Challenge Rules constitute the entire agreement between you and the Platform with respect to your use of the App and supersede all prior or contemporaneous agreements, representations, warranties, and understandings, whether written or oral, relating to the subject matter herein. In the event of a conflict between these Terms and the Official Challenge Rules regarding the conduct of a Challenge, the Official Challenge Rules control for that Challenge.
32. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via push notification or email at least 14 days before taking effect. Continued use of the App after the effective date constitutes acceptance of the updated terms. If you do not agree to the updated terms, you must stop using the App before the effective date.
